How long does an insurer have to respond in California?
California sets time limits on claim handling, and they are worth knowing because they give you something concrete to point at when a file goes quiet. They sit in the Fair Claims Settlement Practices Regulations at title 10 of the California Code of Regulations.
Fifteen calendar days to acknowledge. Section 2695.5(e) requires an insurer to acknowledge receipt of a claim within fifteen calendar days, provide the necessary forms and instructions, and begin any necessary investigation. The same fifteen-day limit applies under 2695.5(b) to any later communication from you that reasonably calls for a reply.
Forty calendar days to accept or deny. Under section 2695.7(b), once the insurer has proof of claim it must accept or deny the claim, in whole or in part, within forty calendar days. A denial has to be in writing and has to state the basis for it.
The clock can be extended, but not silently. If more time is needed, 2695.7(c) requires written notice within that same forty days, and a further written update every thirty days after that. Where an insurer has a documented basis for suspecting a fraudulent claim, the period can extend to eighty days.
Thirty days to pay what has been accepted. Amounts the insurer has accepted are to be paid promptly, and in any event within thirty calendar days.
These are minimum standards for the insurer’s conduct rather than a promise about the outcome of any claim. Whether a particular file has met them, and what follows if it has not, is a question for the Department of Insurance or for an attorney. Regulations are amended from time to time and the current text is published by the California Department of Insurance.
