What does California law add after a breach?
California is the reason a breach costs more here than the same breach elsewhere, and neither obligation below depends on anyone proving they were harmed.
Notification. Under Civil Code section 1798.82, a business must disclose a breach of unencrypted personal information to affected California residents. Where a single breach requires notifying more than 500 residents, a sample copy of the notice also goes to the Attorney General. Notification is a cost before it is ever a lawsuit, and it scales with the size of your records, not the size of your business.
The private right of action. This is the part most owners have not heard. Civil Code section 1798.150 lets a consumer sue where nonencrypted, nonredacted personal information is exposed because a business failed to implement and maintain reasonable security procedures. Statutory damages run from $100 to $750 per consumer per incident, or actual damages if greater. A consumer does not have to show identity theft or financial loss to claim the statutory amount.
Do the arithmetic on a modest customer list and the exposure stops looking theoretical. The statute also sets out a 30-day written notice and cure process before a statutory damages action, and it states that putting reasonable security in place after a breach does not cure that breach.
Two consequences for coverage follow. Notification costs and defense of a statutory damages claim are the two things most likely to be used on a California cyber policy, so they are worth checking limits and sublimits on specifically. And a policy responds to what its triggers describe, so a demand letter under 1798.150 needs to fit the definition of a claim in the form you actually hold.
